Hi!. I am helping my brother for his PERM. He has a BS Electrical Engineering in the Philippines. Is there a requirement to get an education equivalency assessment for PERM? Does he need to have a US Electrical Engineering license as a support for PERM as well?
He has not yet started yet. We are still studying several options. He also has 7 years experience in the Philippines. Can that BS +7 years outside the US count for EB2 PERM?

Guys
Just want to know my options here and here is my scenario:
I am on H1-B and my 6 years of H1B is going to complete on March so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I don't have the copy of my I-140 but I think I can get it.

I filed I-485 in Jan 2007 under EB-1 in Nebraska Service Center. Got finger-print, EAD, AP in April. No other status update after that. Online case registration shows LUD for April.
- Online processing dates show "Dec 19, 2006" for EB-1 I-485. Any idea when I should expect any updates ? What will be the next steps involved ?
- Any way to find out whether my application is sent to name-check ?
- Anyone else in the same boat ? If you filed around Jan/Feb 2007, please do reply back to this thread, or my email vinay.shah73@gmail.com

I have an I-485 that will be current soon, but I am not employed. If they approve it, will that be considered a mistake and make it invalid? Should I withdraw it? Will a letter explaining the situation be sufficient? I have another application as a dependent, just takes longer.

I am trying to analyse the impact based on 245i. Based on it
PIC countries benefited from unused visas a lot till now to have their PD current/move up. So based on that benefit, Also one thing is clear the unused visas if available are country indepedent and are used at the rate of 27% per quarter.
so for example 100K visas are available (which i would enjoy having )27K per quarter is available from the start of the year . Now among this 27K how is the distribution, can it be distributed whichever applicant needs PD IRRESPECTIVE of EB1,EB2,EB3(skilled, professional) Vs EB3 other or does it split by the calculations of EB1, EB2, EB3 with 28% EACH and EB3 other NOT above 10K limit

Change of Status to F1: 12/2001
Change of Status to H1: 10/2004
Labor Filed Substitution: 07/2007
Appeal: 11/2009 in process
I calculated my time in USA excluding time spent outside the country and my 6 years will end in June 2010. When my employer renewed H1 back in 2008 he simply claimed for 3 years and USCIS approved till 03/2011. But I read somewhere online that we have to calculate our time spent in the country and should not go by the date that is on our H1.
1. Does the change of status from H1 to F1 reset the H1 time period or do we have to consider that time period while calculating the 6 years
2. As my application (AAO) is pending I heard I will get a one year extension. The question I have is can I stay on my current H1 till 03/2011 or do I have to renew my H1?

Please help reactivate this group. We have 27 members on our group but it's hard to get 1 reply. We have successfully met two lawmakers recently and more such contacts are urgently needed. Does anyone know how slow/fast/better is the Counsular Processing back in India if you ever become eligible to do that?

Don't go for it. It may be fast but you are working with too many variables that may go wrong. I went back home last year for CP and suddenly I became a victim of retrogression. I missed my cutoff date by two days. Then I had to wait for about 3 months to get my H1 stamp. I was lucky that I didn't lose my job here.

The July bulletin shows the date as 15th Aug 2003. It's difficult to estimate when it'll get to July 2007 because the movement is not linear.
