My job title changed from programmer anaylst to technology and system anayst. This was an internal change in my company where they re classified everyone. My job duties remain exactly the same. My employer is also willing to write my job title as the old one on the employer verification letter.
However there is a slight problem. My recent pay stubs show my new job title. Nowhere else the old job title is mentioned..
will this be a problem?
Should I put my new job title as the one in 485 application even though my 140 and perm labor had my old title?
Please suggest

Your PD is not Current also there is no premium processing for EB2 yet. You can file I140 through your Lawyer.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. I have a last pay check through an Employer A of August 1, 2008. Earlier before leaving Employer A I filed a H1 transfer to a new employer B and that got approved by USCIS but I didn't start working with Employer B. Now I am getting a new offer from Employer C which is better than Employer B. Attorney of Employer C says that he can file for a transfer through company A as the pay check is less than two weeks.
Now my problem is I not sure whether my transfer from A to C would be successfull or not?
Another thing I have not informed Employer B that I will not be joining him, Do I have to pay him all the H1 transfer fees?

Hi,
I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.
4. I have approved I-140 also.
So 1) which will be the Service Center of mine to apply my H1B Extension
2) I heard Approved I-140 will be an advantage for a 3 year H1 extension application, but do this really matter if I have 3 months Purchase order or Contract with the client.
Please let me know.

Hi All,

My wife got H1B stamped in hyderabad consulate last year. Due to recession, she applied for H4 to join me in US, got H4 stamping in hyderabad, during which
H1 Visa was cancelled[expected..]. we have H1B Petition docs which says it is valid for 3 years. My wife came to US on H4.
Now can't she apply for Change of status from H4 to H1 as we have petition docs, which are valid for 3 years?
when contacted the actual employer, they said, when H1 visa is cancelled, it means, H1B petition also cancelled. Is it true?
Please suggest.

To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.

I am on H1-B Visa and my wife on H4. She filed for GC in Schedule A(I140&I485 filed concurrently) category. Her I140 is not approved yet. We both got our EAD cards but have not worked using our EADs. I do not intend to use my EAD to work. Our question is:
* If her I-140 gets denied will she still have her H4 status as I am still maintaining my H1?
* If not, how can she get back to H4 status? Will she be asked to leave the country immediately?
Need immediate reply.

Hi,
I have a VISA appointment in Vancouver, CA for stamping my US H1 B visa.
I was wondering if anyone has gotten there H1 B stamped from Vancouver lately. I want to know if they hold on your passport for a day and return it to you next day or do they return it on same day?
I need to plan on my return trip. Any help is appreciated.

Do not do this - please stop playing around with USCIS rules. There are sometimes unfortunate circumstances where folks lose status (e.g., OPT -> H1b) or are kept in dark about their H1B status by employers but for folks who break the law in a way that you are suggesting, I believe they should be punished.

My current employer 'C' is in the process of filing Labor certification. I have to fill out Form # 9089 and give it back to my employer with past employment specifics.
I left my past employer 'A' on 9/23/2005, though was paid till 9/30. For the next month or so I was at home looking for a job on my own. When I did get successful I approached a consultant 'B' who filed for my H1-B transfer and offered me a appointment letter. We together kept looking for a job till 11/29 when I actually started working. When I got experience letter from these employers they told me that it is from the start of project date that you were on payroll. I am also sure that my employer 'A' did not inform the INS immediately but took about 15-20 days to send a letter after I had left.
My question is what dates should I put on the form, the actual dates or the ones I have on appointment letter
