I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.
Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?
I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

From the Houston Chronicle: More Texas voters think unauthorized immigrants should be allowed to stay in the United States � through either a path to citizenship or work visas � than favor deporting them, according to a new Houston Chronicle/San Antonio Express-News poll. The poll showed that 38 percent of respondents favoring deportation � drawing the most support of the three options offered. Twenty-nine percent favored a way for unauthorized immigrants to attain citizenship, while 23 percent supported work visas.

The I-131 Form update date shown by NSC is 10/18, whereas many of the folks are still awaiting their AP's...and even Texas says I-131 processing date current....So how come majority of them still waiting for AP ??

Check with your school's office for International students...Nowadays many schools require that you work their own office....They have an attorney and you just submit papers and they take care of it....

Hi all, I have a question regarding my current situation. I'm currently working for this non-profit organization under my OPT that is good until the end of Oct of this year. My question is basically whether or not I can ask my employer (already agreed) to petition for me for an H1-b visa? Can I still apply right now before my OPT expires or would it be better to apply next year on the first day of April? If I can get an approval for my H1-b would it be good to get a TN in the meantime and later have my employer petition me for an h1-B then?
Any suggestions would be greatly appreciated as I don't want to waste the opportunity to apply if I can get one at this time. I heard is better and easier to apply for one while under OPT than TN to H1-B but I'm not sure or rather confused about this!

Apologize if this has been already answered, I was just curious after I change jobs using EAD, I just quit and sit idle at home for a while. Is that possible, or on EAD one has to be always working?

Hi,
I have changed to a new employer using AC-21 recently. I have pro-actively sent AC-21 documentation (new offer of employment, covering letter and supporting docs) to USCIS. Ever since, I am checking my case online. Its about 3 months now that I have sent this info and there has not been any update/LUD on my 485 case so far. I am not sure if my I-485 case has details about my new employment.
I am currently doing my EAD renewal. I am thinking if it will be possible to indicate to USCIS about my new employment. Can you please advice on -
a) if it is wise to do so?
b) How can it be done?

I applied for I-485, I-140,and EAD almost 2 months ago..The package was received by USCIS but no receipts yet, no checks are cashed yet...We called and they said it may take 3 months to issue receipts...what should I expect?Receipts and approval of EAD in a month given that they usually honor the 3 months period to approve EAD?or nothing is guaranteed!!

Can I travle outside US after applying for conversion. Need some one to response ASAP
If you travel out of the U.S. while an application for change of status is pending the USCIS will deny the pending change of status application.

what an ignorant ass. doesnt he realize that IV core is made up of us. I am in my 8th year H1-B( came in 1999 first to USA) extension based on pending I-140 & I-485 , I have my 2nd EAD in So now my question is
Is it safe for me to switch to EAD or keep extending my H1-B till I have my I-140 and 485 is approved? My I-140 has been pending for the last 2 yrs because of the FBI security checks etc. Since my H1-B extension beyond 6 yrs is based on pending I-140 and I-485 does it really make sense to keep extending it since I have to pay from my end my employer doesnt pay for it or is it better to be on EAD?

For PERM, 73.8 percent of applications were processed within six months, exceeding the target
of 65 percent, though performance declined from the prior years. PERM performance was
affected by the reallocation of resources to eliminate an applications backlog in the H-2B
Temporary Non-agricultural Program. In FY 2008, the DOL will closely monitor
implementation of the Fraud Rule for impact upon PERM processing and redirect resources that
were used to eliminate the H-2B backlog to the PERM program as needed. Keeping these
factors in mind, the target for PERM application processing within six months will be 76% by
FY 2009.
