I am currently on H-1b and my wife is on H-4. My current job will be terminated on 8/15 and my wife has received H1b approval notice to start full time on 10/1. We have a US born baby who requires future post-surgery follow-ups. I was on F-1 visa, requested OPT through the university, but I didn't applied to USCIS, because I got H-1b premium processing approval. My wife has a valid H-4, and unexpired B1/B2 visa. So my questions are:
a) Between 8/15 and 10/1, are we out of status?
b) I should file a change of status. Should I file
(b-1) H-1b to H-4 directly (effective 10/1)?
(b-2) H-1b to B1/B2 (before 8/15), then B1/B2 to H-4 (effective 10/1)?
(b-3) H-1b to F-1 (before 8/15), then F-1 to H-4 (effective 10/1)?
(b-4) F-1 OPT with university endorsement, if they are willing to do it?
c) Do I need to go abroad and actually get B1/B2 visa since I never got one? I think a change of status should be okay.
Any suggestions are welcome. Thanks.

Hello
I am in AOS with priority date of EB2 Dec 2006. We are moving out of USA due to spouse getting a job outside of USA. If we want to retain our priority date and green card, what are we supposed to do before and after we leave USA?
In case we want to make temporary visits to the USA, do we have to apply for visitor visa? I am assuming that we will not have AP since we are not inside USA. Will we even get a visitor/business visa since we have an immigrant visa which is pending with USCIS?

I need help for my friend. My Friend's spouse on H4 started to work on EAD. She does not work (or if she gets laid off), will she automatically get her H4 status? If not, what does she need to do to get back on H4. Her husband is on H1.

I am one of the ones who had missed the July 07 boat. My PD is finally current.
My attorney is getting ready to file all the items (485, EAD, AP etc) tomorrow.
How soon can I expect the FP Notice?
Also, since I am applying only now, how long before I can hope to see Green?

yes. it can be done inside USA by filing I-539.
The school must first issue I-20. Then, you can file I-539 with the INS by attaching the I-20.
INS will approve it and return you I-20 along with a new I-94.

she will be on EOD once she quit the Job. You may not have to file COS to H4.
My wife quit the job last year she was on H1. and we didn't get any RFE till date..
She also went to India and came back on AP this year...

i have been offered a job at my current research centre where i worked as a student. I want to go back to my home country. The job can be done online and does not require physical presence in the USA. Will i still need an OPT? or can they employ me as an international worker? if they wmploy me as an international consultant then what are the ramifications for teh company? wht is the legal procedure? will they have to pay taxes more etc?
Please help

I am using Advance parole in december to visit India. I have applied my canada PR in 2008, but I don't have stamp of PR in my passport.

I believe they promise a 15-day (business days, I assume) turnaround on Premium Proc applications. So it could take anywhere between 1 and 15 days, if not longer in certain cases.
Also, why is going to India dependent on receiving on an approval of I-140??

Hi,
Need good advice.
My fiancee had an approved post decision status on her H1B application. She's waiting for an interview in the US Embassy for final approval.
We're planning to get married so that she can bring me and our 2 year old son.
My concern is what will we do, will we marry before her interview or after her interview?
Another biggest concern is I have a pending petition from my mother who is US Citizen, I belong to F1 Category. I know that if we'll get married my petition will move to another category which is F3.
So this is a bit confusing whether we will marry before her interview or after her interview?
Please put some inputs. Thank you very much!
