My original birth certificate has all the details needed, except that my last name is an initial, and not spelt out completely. Would I require an affidavit with an expanded last name?

I was on F1 visa and applied for my GC / I485 thru my spouse few years back. Unfortunately while coming back from India 3 years back, I used my stamped F1 visa instead of AP. My lawyer told me that due to this, I have abondoned my AOS and he has to withdraw my 485 and refile it when it will be current. Few days back spouse became current and attorney was preparing to apply for 485 again but in USCIS the status of my application was still shown pending not withdrawn. To our surprise, we saw 2 GC in the mail and the online status was shown approved. But the attorney is saying that we should re-file the 485 since USCIS did not withdraw my application and approved it. They says that I might have issues if my absence is detected when I will apply for citizenship later. Please suggest. I am so puzzled and tensed..

I'm in the 8th year of H1-B, BEC priority date 04/2001, just got a notice that the case was closed ?? and the lawyer is working to reopen the case.
I have now a very good opportunity to work for another company, huge pay and benefits, a lot of pressure from this company to work for them.
Pls who can answer 2 small questions:
1. Do I have a chance to work for this company?
2. It makes a difference if I'm currently in NJ and this new company is in Utah - thinking that maybe they are not so many applicants in that state? Just for the LC processing speed?

Hi,
I am in a situation where I changed my Job and new organization has filed the Visa Transfer process on 28 May 2010.
My and my dependents current H1-B / H4 and I-94 from the prior organization is expiring on March 14 2011 and the H1-B Transfer process has not been completed and rather it is now in the RFE Status as of Today i.e March - 7 2011.
Am I still eligible to stay in US or not. What should be my next course of action.
Please suggest at the earliest.

I have this thought. We start a letter campaign sending letters to all the house members: 1) To get them aware of Legal immigration and 2) To put our case fwd.
I feel it will be very effective as the flower campaign. Atleast most of us can participate in it, less expensive, less time consuming. And we can see why we wouldn't they respond to the bulk of mail they are getting every day.
I know we did letters through email etc. But i think sending through post will be different and they will be obligated to respond.
I do not know whether this is a good idea. so please dont rush at me.:)

I am currently starting a language institute in California. I incorporated the organization 2 years ago, but I am starting it now. I want to hire a Brazilian national on an h2b visa to teach Portuguese but I am worried that as I am starting the business now and haven't generated income yet I won't be allowed to hire this teacher. Is this something I should worry about? Thank you for any help. I appreciate it.

You must have at least two years of post-baccalaureate experience in a high-tech field to be eligible for an H1-b visa, or else have a masters or higher degree. So where did you get your experience? Are you still back in your own country? Working? Or did you just get your bachelor's in the US and are still in the US,

One of the docs folks usually send is an employment letter from your new employer detailing the job duties, etc.
Most would give you this only after you join the new employer.
I don't think an offer letter with job duties would suffice.
