Hi all, I have a question regarding my current situation. I'm currently working for this non-profit organization under my OPT that is good until the end of Oct of this year. My question is basically whether or not I can ask my employer (already agreed) to petition for me for an H1-b visa? Can I still apply right now before my OPT expires or would it be better to apply next year on the first day of April? If I can get an approval for my H1-b would it be good to get a TN in the meantime and later have my employer petition me for an h1-B then?
Any suggestions would be greatly appreciated as I don't want to waste the opportunity to apply if I can get one at this time. I heard is better and easier to apply for one while under OPT than TN to H1-B but I'm not sure or rather confused about this!

My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?

Program is the name of your main application's class itself. What I am doing is creating an instance of my application and using the two methods that live inside that class.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. It seems to me that USCIS are rejecting applications to establish new dates for refiling. Isn't it in their FAQ on Receipt delays that by law, they are required to issue EAD within 90 days from the applications?
I hope I am wrong but they might be doing this deliberately to get around the law.

I am on H1. I got married earlier this year :), my wife is on OPT which expires early next year. She is currently working for XYZ company which would not extend her OPT. We haven't been able to find a job(H1) for her yet.
Would any of below can cause any problem.
1. I don't have H1 stamping from my home country??
2. Her last name is not changed??

I have a certain labor category approved 19-#### and AOS is applied . Now the job I am looking at moving to has the same number (19-####) but the job duties are not exactly same. Will this be OK for AC21 or will I have problems?
