mate take it easy. my appli's were sent to NSC on august 1st and i still haven't seen any receipts come through for 485, ead nor AP. Although I have received Ead card and done finger printing so that way I know what my 485 appli # is but no info on the AP

My daughter (5 yrs) is an US citizen and having passport valid until end of Sep 2009 and having POI card for 15 years from Indian consulate.
Now I am planning to take her to India for 3 weeks from Aug 1st week. The travel agents says her passport should have at least 6 months valid from the date of date of the return (Aug 4th week). Is that true/correct? Can she enter here in USA after her India visit with 20 days left in the passport validity?
I will be using my AP though I maintain H1B status (I-797) and work for the same employer.

1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. Previously, I had been projecting March, but the overall usage of H-1Bs has been somewhat busier in the last month than in previous months. The masters cap usage this past week was 500 and the monthly average is 450. There are 3,800 H-1Bs left of 20,000 and I am projecting that cap will be exhausted in late December,...

I mean what happens after FP?
Do they work with your application only when the PD is current?

When to expect EAD /AP if I had filed my EAD/485/ on June 10

Whatever you call it, you are really always applying for a new EAD. There is no such thing as renewing an existing EAD. The I-765 form that you complete will ask about any prior EADs that you had. If you do not have details, please put as close to the facts as possible. If you still have a CIS receipt number, definitely include that so CIS can look up the details.

I need to renew my H1 for the 9th year and was wondering if I need to pay the ACWIA fee of $1500. It seems employers who are filing for a 2nd extension are exempt from paying. Does it apply also to cases beyond the 2nd extension?

My H1B expired when I renewed (last month) my EAD. I e-filed it and selected H1B "SPECIALITY OCCUPATION". I got my new EAD card in hand within 22days from the day I filed.

The Cap seem to be moving slowly in the past few months, but something is different with the release of the new count this week.
As of September 18, 2009, approximately 46,000 H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. It seems that some employers are hiring again and willing to file for H1B visas for specialty workers. This is a good sign, but this also means that visas may run out sooner than expected.
USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

You can initiate the process for both of you individually. Means u can apply Labor, I-140 individually. After that while applying I-485 its advaisable to move with the lawyer suggestion. So till I-140 you both can apply individually.

My employer is not willing to give the user id and password of the secured sire through which they filed the labor.

Status of PERM can only be checked by your employer (with their user id and password of the secured site). Unfortunately there is no other way to check the status.
